Zimfox
Terms and conditions
1. Scope and customers
These terms apply to Zimfox contracts with consumers and businesses. Mandatory consumer rights remain unaffected. The contracting party is Mathias Wallem, Zimfox, Am Felde 13, 25488 Holm, Germany.
2. Service
Zimfox provides website checks and monitoring packages. Each monitoring package is assigned to exactly one website and, following confirmed payment, includes an initial scan, regular availability checks, weekly full checks, reports, notifications and supported targeted problem rechecks within the product scope described at purchase.
Automated checks provide technical indications within the inspected scope; they do not replace a complete manual legal, security or accessibility audit and do not guarantee an error-free or continuously available website.
3. Contract and payment
In checkout, the customer selects the website, term and payment method. By using the clearly labelled payment-order button, the customer submits a binding offer. The contract and its monitoring package are activated only after successful payment confirmation and acceptance by Zimfox. The total prices displayed immediately before the order apply. Payments are made in advance using the offered PayPal or Stripe payment methods.
Zimfox currently applies the small-business tax exemption under section 19 of the German VAT Act (UStG). VAT is therefore not shown separately.
4. Term, extension and website binding
Monitoring packages run for 1, 3, 6 or 12 months and do not renew automatically. During the available extension window, another prepaid period can be purchased and follows the package end without a gap. Each active website requires its own monitoring package assigned to that customer and website. A domain change is not provided for under the existing contract.
5. Developer access and rechecks
The customer may grant time-limited and purpose-limited developer access for a specific website. That access and the ability to trigger targeted problem rechecks exist only while the access is valid and the website remains eligible under its monitoring package. Developer access does not create separate monitoring eligibility.
6. Refunds, withdrawal and invoice corrections
A statutory withdrawal, another agreed refund, a partial refund and another form of contract termination are distinct events and are handled according to their respective legal and contractual basis.
Every successfully confirmed full or partial refund completely ends the monitoring associated with the affected purchase. Any remaining financial balance after a partial refund creates neither a remaining service term nor further monitoring eligibility.
The original invoice remains unchanged as a historical document. For a confirmed refund, Zimfox may create a separate immutable document labelled “Invoice correction” that refers to the original invoice. A partial refund does not create a new partial invoice for the remaining financial balance.
7. End of contract and history
When the term expires or the contract otherwise ends, current monitoring eligibility ends. Active monitoring functions and new rechecks are then no longer available. Historical reports and invoices, invoice corrections, payment and contract records required by law or contract may remain under the applicable retention contract. There is no automatic paid renewal.
8. Duties and acceptable use
Customers may only have websites checked and monitored where they are authorised to do so. Credentials must be protected. Abusive, unlawful or security-threatening use is prohibited.
9. Defects and liability
Consumers retain their statutory rights for defects. Zimfox has unlimited liability for intent, gross negligence, injury to life, body or health and other mandatory statutory cases. For slightly negligent breach of material contractual obligations, liability towards businesses is limited to typical foreseeable loss. Mandatory consumer rights remain unaffected.
10. Privacy, law and jurisdiction
German law applies while preserving mandatory consumer protections of the consumer's country of habitual residence. For businesses, the provider's registered place is the place of jurisdiction where permitted. Information about data processing is contained in the privacy policy.
11. Consumer dispute resolution
Zimfox is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board. Mandatory information duties in an individual dispute remain unaffected.
